You consent and submit to the non-exclusive jurisdiction of the courts of the province of Ontario in any action or proceeding instituted under or related to this Agreement.

  • If any provision of these terms and conditions is invalid or unenforceable under applicable law, then the invalid or unenforceable terms and conditions shall be, to the extent necessary, deemed omitted and the remaining provisions will continue in full force and effect.

  • Unless specifically provided herein (and subject to the terms of any other written agreement that you have with Cymbria) these terms and conditions constitute the entire agreement between you and Cymbria with respect to your use of this Site. There are no representations, warranties, conditions or other agreements, express or implied, statutory or otherwise, between the parties in connection with the use of this Site except as specifically set forth herein.

  • Cymbria maintains policies and procedures in accordance with the provincial regulations of Alberta, British Columbia and Quebec, with respect to unclaimed property. Generally, property is deemed to be "unclaimed" if mail and cheques have been returned to us and we have been unable to locate the investor for a three-year period or longer. Cymbria makes all reasonable efforts to locate and notify owners of their unclaimed property by contacting their financial advisor and/or writing to the owner at their last known address. Cymbria maintains a list of owners of unclaimed property who we have been unable to contact.

This Privacy Policy applies to the business conduct of Cymbria Corporation.

Cymbria values your trust and is committed to safeguarding your privacy and protecting the personal information you provide to us. This Privacy Policy is designed to help you understand what information Cymbria collects, and how we use and safeguard that information, and with whom we share that information.

  • We collect the information you provide to us on account application forms, paper or electronic instructions, and telephone instructions from you and/or your financial advisor. This information may include your:

    • Social Insurance Number

    • Financial advisor information

    • Beneficiary name(s)

    • Telephone and e-mail

    • Date of birth

    • Banking information

    • Investment instructions

  • We limit the collection, use, retention and disclosure of your personal information to that which is permitted or required by law, or that which is reasonably necessary. We may use your personal information for these stated purposes:

    • Entities to which we are legally obliged to provide information

  • We maintain physical, procedural and electronic controls appropriate to the sensitivity of your information, to protect it against risks such as loss or theft, unauthorized access, disclosure, copying, use, modification or destruction. These safeguards include secure office premises for authorized employees only, secure networks, and secure databases. We protect your personal information disclosed to third parties by ensuring that such parties have policies in place to protect the confidentiality of the information.

  • When you agree to use our services or submit personal information to Cymbria, either directly or through your financial advisor, you are consenting to our collection from, verification with, and communication to, any third party for the purposes described above. You also consent to the collection, use, disclosure and processing of your information by Cymbria’s agents and service providers for the purposes set out in this Privacy Policy. You may withdraw your consent to our use of your personal information by contacting us in writing. If you withdraw consent, you may limit the services or products we are able to offer you.

  • You may access the personal information we hold about you at any time by advising us in writing that you wish to do so. We may be unable to provide you with some information in certain circumstances, such as if the information also refers to other individuals, is subject to legal privilege, contains confidential information or is otherwise permitted or restricted by law.
